Welcome to PromptedComms, a division of The Jason Button, LLC, an Illinois limited liability company (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and your participation in our services, including but not limited to live trainings, workshops, consulting, strategic advisory, and implementation services such as the PromptedComms Agency Accelerator (collectively, the “Services”).

By accessing our website or participating in our Services, you agree to be bound by these Terms.

1. Scope of Services

PromptedComms provides education, training, consulting, and implementation services related to artificial intelligence applications for communications, public relations, and marketing teams. Services may include live instruction, strategic guidance, system configuration, workflow design, and integration of third-party AI tools into client environments.

Specific deliverables, timelines, pricing, and payment terms are governed by separate written client agreements where applicable.

2. Live Trainings and Workshops

Live trainings may be delivered in person or virtually (e.g., via Zoom). Unless explicitly stated otherwise in writing, no recordings will be provided.

Screenshots, audio or video recordings, screen captures, or replication of any portion of live training content are strictly prohibited.

3. Agency Accelerator and Implementation Services

The PromptedComms Agency Accelerator and related implementation services involve the configuration and setup of third-party AI tools and workflows based on materials, access, and instructions provided by the client.

You acknowledge and agree that:

• All third-party platforms (including but not limited to AI tools, document storage systems, and collaboration platforms) are owned and controlled by their respective providers.

• Functionality, availability, and features of third-party platforms may change without notice.

• We do not guarantee uninterrupted operation, future compatibility, or continued availability of any third-party tools or integrations.

4. Client Data, Access, and Responsibilities

To perform the Services, clients may grant PromptedComms limited access to files, systems, or platforms (e.g., Google Drive, SharePoint).

By doing so, you represent and warrant that:

• You have the legal right and authority to share all materials, data, and access provided.

• All materials supplied are accurate, lawful, and appropriate for the intended use.

PromptedComms:

• Accesses client data solely for the purpose of delivering the Services.

• Does not assume responsibility for the content, accuracy, legality, or completeness of client-provided materials.

• Does not control how AI outputs are used after delivery or handoff.

Unless otherwise agreed in writing, access to client systems is temporary and revoked upon completion of Services.

5. Use of AI Tools and Outputs

PromptedComms provides education and configuration related to third-party AI platforms. You acknowledge that:

• AI-generated outputs may be inaccurate, incomplete, outdated, or inappropriate.

• All AI-generated content must be reviewed, fact-checked, and approved by a qualified human before use.

• AI performance and outputs may change over time due to model updates, policy changes, or platform modifications.

PromptedComms makes no representations or warranties regarding the accuracy, reliability, or suitability of AI-generated outputs.

6. Intellectual Property

All PromptedComms content, including but not limited to training materials, slides, prompts, frameworks, workflows, methodologies, and documentation, is the exclusive intellectual property of The Jason Button, LLC.

Clients are granted a limited, non-transferable, non-exclusive license to use materials for internal business purposes only. Materials may not be resold, redistributed, sublicensed, or reproduced without prior written consent.

Client-owned data and materials remain the property of the client.

7. No Guarantee of Results

Services are provided for educational and informational purposes. We do not guarantee specific outcomes, media placements, business results, operational efficiencies, or performance improvements.

Examples and demonstrations reflect current technology and may not represent future AI capabilities.

8. Nature of Relationship

Nothing in these Terms or the Services creates an employment, partnership, joint venture, fiduciary, or agency relationship between you and PromptedComms.

You retain full responsibility for decisions, actions, and outputs generated using AI tools after Services are completed.

9. Limitation of Liability

To the fullest extent permitted by law, The Jason Button, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

• Loss of data

• Business interruption

• Third-party platform failures

• Client misuse or reliance on AI-generated outputs

Our total liability, if any, shall not exceed the fees paid for the specific Services giving rise to the claim.

10. Communications

By engaging with PromptedComms or submitting your contact information, you consent to receive communications from us, including newsletters, service updates, and announcements. You may opt out at any time.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
